Jamaica I agree...no probs with anything from Indiegogo.....kickstarter I've been burnt several times....I'm done! The things I have gotten took 1-2 years to get...and quality was poor!

Hey Lee, I have reached out to the creator several times through email and gotten responses back, though I have not in some time, I have also reached out here on kickstarter and reached out on Instagram and have been getting radio silence where I was the only one for a while that was getting a response. This recent silence has me advising to review some of Gerald's posts on action that can be taken to protect yourself

Just a question has anyone tried reaching out to the company / creator of this project?
Only reason I'm asking this is because of personal problems I've had not too long ago which caused me to drop out of site and disappear on people I'm currently working on a project with.
Not that anyone should give a sh!t about my personal life but lets face it. Tragic things happen and I pray that no one has to go though a trying time but that's life...but anyway. Silence is never the way to go when money is involved, clearly. If anyone has any info on reaching this company please pass it along and I will see whats up and in fact if they are trying to screw us and if they are then you'll get what you deserve if not then just let us know what's up. We believe in you and your idea enough to back you just reach out and I hope you're not going though anything personal. Peace.

if the creator was even attempting to make an effort and follow kickstarter terms and policies by updating us, but they have vanished, so I suggest we do this, since the creator appears to have no other alternatives: 1. I have done some digging and have found that you can either quote section 75 or chargeback (debit cards). You can tell them that you want to dispute a transaction about an undelivered product. Here is one link about chargeback http://www.which.co.uk/consumer-rights/advice/how-do-i-use-chargeback 2. You can also call your credit card company and tell them that You want to file a fraud claim for non delivery of a product. That's what I urge All Backers to do, immediately, (i.e. Contact their CC company and file a fraud form for non delivery) especially since the creator just hides from his own backers and refuses to face them, everyone knows what that so obviously conveys.
Trust goes both ways, like any other relationship.
Some backer relaying updates to shield the Creator is the same as *no communication*, period.
Unfortunately it's time to call this project officially a failure, albeit, to be fair I fear it was a scam, all along.

I'm not trying to shield the creator, I'm just being proactive in getting and providing information where the creators won't so that you guys at least have SOME information. But frankly at this point no update is going to be adequate and I can understand the creators reticence to update, regardless of the fact that it needs to happen, because as soon as they do, regardless of what they say, there is going to be tremendous backlash. And Gerald is going to at the head of the lunch mob. At this point however I would not begrudge anyone speaking with their bank to get the funds returned given the circumstances, in not telling anyone to do otherwise, I'm just providing what information I am able to get from the creator and still hoping to see good on their product.

I myself can be patient but there are no updates from the creators that's the most frustrating part, I think if they would give backers updates and a new delivery time it would set some ease of minds

For perspective, and not in criticism of Gerald, because a lot of what he says in the comment below is valid, even if we don't agree about this particular project, I am also a super backer, and have so far never been scammed, and never not received the product a backed for out of over 100 projects backed, some have taken much longer than their projected ship dates, but so far I have gotten every item before reaching a point where I felt like I wasn't going to receive it. I have had an extremely positive experience with using Kickstarter and the rewards I have received. But I would advise maybe I am more patient or tolerant than some and if you feel like you are beyond an acceptable frame of acceptance with a delayed project Gerald's advice about fraud reporting and charge back policy is sound.

Hope this helps other kickstarter fans and potential backers from saving their hard earned cash. kickstarter doesn't care, since they get their cut. they have not even once ONCE posted a reply to me to address any of my concerns. So, even more to you fellow backers, SAVE your hard earned money and wait till a product comes to market, kickstarter is way too risky. Its like betting your retirement plan on placing a it on 'black 22', i.e. roulette except your odds are better. Hope this helps.

Again, I have gotten responses back from the Atlium team, they even mention you (you should feel special) and the responses are satisfactory; I have no doubts Atlium will follow through and is only a severely delayed project (Like many Kickstarter projects are). But I look forward to your next round of, albeit repetitive by now, posting, if only because I think you are a joke. A particularly funny joke.

As a class action suit, theft of items valued at $10,000 or higher and less than $1,000,000 is a Class C felony. Depending on *if* all claimants want to settle as a group or individuals. I am sure that is not a desirable outcome. So, please do the right thing and issue refunds.

OK I am being ignored. 1. they should be addressing backers concerns, not ignoring their backers. 2. please, keep attempting to belittle other backers and their very valid concerns, see how far that gets you @Justin. 3. I am sure that all the backers [excluding you @Justin] that have backed this campaign for a 0 return and total silence from the creator, think the same thing. 4. There is absolutely no cause to ignore use for a month +, when all it takes is 5 minutes to post an update. Unfortunately, the real truth is that the funds are gone. I am sure the creator will eventually post this unfortunate fact and come up with some lame excuse. 5. Atilium asked for our help funding their product. That is part of the crowd funding concenpt. I guess what I'm saying, Mack, is that you don't need to post every month or so because you make no difference, and I don't think I can be clearer when I say that: You literally have zero impact posting here, and I would argue that your harassment of the Atilium team makes them less likely to respond. I sent an email to them after writing up my post telling you how profoundly insufferable you are and received a response from them yesterday AM. All of us aren't all being ignored, but YOU are being ignored.
In the 100+ projects I have backed I have seen worse communication and longer delays and still gotten a great product in the end, and no one had to threaten legal action to see it happen. I'm not asking you to be patient, I'm asking you to be quiet.

@Gerald Mack you are being inflammatory and hyperbolic. It's pretty clear that you aren't happy with how thing are being handled, and no one expects that you should. but you are culpable for being an adult, not posting repeated, alleging and accusatory comments that repeat the same thing.
If you feel like legal action is necessary then pursue a claim privately, and please do it quietly, reaching out to the creator directly, and if it holds then you can recruit other backers to sign on. If you have taken your issues directly to the creator and are not getting a response back, then you aren't going to, posting on here repeatedly is not going to change that. So please, shut up, I am sick of reading your posts, I share your frustration, and I have reached out to, and gotten a response back from, the creator without needing to saturate this board with my complaints and threats. Either we will get more information or we will need to take legal action, but you posting over and over again is not going to make a difference. Accept that and please stop.

This was the first project I ever backed I had no idea that there weren't guaranteed the product there is a lack of updates we keep hearing about locking in a factory this is wire fraud and if something doesn't happen I'm going to submit a claim there has to be legal obligation you can't just run off with over 23,000 and have no obligation to either refund or provide a product
