Dear Bob, I have received 31 names as full and final for the statement of claim. As I have stated in the past, we will need minimum of 40 names to cover the costs. However, I am persuading my principal solicitor for lodging the above SOC with these 31 names only. This is a kindly notice and may use any in proceedings as it is the only way of communication and announcement with you (Mr. Bob Gruder). All backers inclusive of myself have tried to solve the issue with you in all the manner but you refused to make any progress as you are legally obligated to fulfill the promises of your project. again we remind you that you must give backers a recourse if they don't and as a creator you have not made a good faith effort to complete the project and fulfil this project or any offer to the backer. Please update immediately

I sit and look at my SmoothVu case that I haven’t opened since I got it and wonder will this turn out for the better? Is there any update you can give on ANY progress or no progress to tame the festering frustration of not being able to use this product as intended? I really think it’s as simple as what I’m doing here... post an update with what’s going on to at least restore some form of trust that you aren’t scamming us out of our money.

Kickstarter's Terms of Use require creators to fulfill all rewards of their project or refund any backer whose reward they do not or cannot fulfill. (This is what creators see before they launch.) We crafted these terms to create a legal requirement for creators to follow through on their projects, and to give backers a recourse if they don't. We hope that backers will consider using this provision only in cases where they feel that a creator has not made a good faith effort to complete the project and fulfill.

If the problems are severe enough that the creator can't fulfill their project, creators need to find a resolution. Steps could include offering refunds, detailing exactly how funds were used, and other actions to satisfy backers.

If problems come up, creators are expected to post a Project Update (which is emailed to all backers) explaining the situation. Sharing the story, speed bumps and all, is crucial. Most backers support projects because they want to see something happen ?????!!!!?????

Bob is just an unreliable son of bitch. We all lost money. Very disappointing that he can just start another project, raise money and not fulfilling his promises on this project. Basically het stole $49.078 from his backers. Thats a more then average yearly salary for John Doe.

5 weeks since the last update. I'd like to hear something. Were the new units you tested any good? Do we have a timeline now that the other Kickstarter has concluded? He only got 7500k above his initial budget from the Kodi project. I’m still mad of the fact that he tries to solve a failed kickstarter project with another one. Like I said in my last message, don’t expect anything this year. Especially with his low attention and response rate here. He won’t and can’t give us money back. While Bob has been trying very hard to rectify the mistakes and errors in fulfilling the promises of this project, it just seems a lost cause now. My SmoothVU is practically DOA and unusable as it stands. Overall not the quality that was expected. Refund would be the right thing to do - since the product is not as per the initial descriptions and information. But that seems to be out of reach - knowing that correcting this project depends entirely on the success of another Kickstarter project.
